TERMS & CONDITIONS
  1. Announcements day of the sale will take precedence over all written materials.

  2. All items are offered “AS IS, WHERE IS”. All sales are final. No claim will be considered for allowance, adjustment or rescission of any sale.

  3. All bidders must be over the age of 18 and capable of forming legal, binding contracts. A $100.00 refundable deposit along with a photo identification card will be required to register. The registration deposit can be paid with cash, cashiers checks, credit or debit cards. In the event the buyer does not purchase anything the deposit will be refunded. In the event the purchaser fails to pay the full purchase price for any lot within the prescribed time, or fails to comply with any other terms of sale, the Auctioneer shall retain the deposit for application against any such deficiency, expense or charge as liquidated damages.

  4. 13% Buyers Premium will be added to the bid price of all purchases with a 3% discount for payments made with cash or cashiers checks. We accept the following forms of payment: Cash, Cashiers Checks, Visa, MasterCard, Discover, American Express, and Debit Cards. No personal or company checks will be accepted.

  5. All sales are final upon the award of bid at which time a 25% deposit is required. The balance of the purchase price shall be paid no later than two business days after the auction and, in any event, prior to the removal of any lot.

  6. No lots may be removed until the conclusion of the auction and then only small items, although invoices are available for payment at any time. All lots must be removed within the time announced or posted at the sale, usually the two business days immediately following the sale between the hours of 9:00am to 4:30pm. If for any reason the purchaser fails to remove any lot within the time specified, the lot shall be deemed abandoned, and the Auctioneer may re-sell or dispose of the lot. No refunds or adjustments will be made.

  7. Upon award of the bid, the title and all risk of loss, damage to, or destruction of, the purchased item passes to the purchaser. Auctioneer and/or Seller shall have no liability whatsoever for any damage to, or destruction of, any such lots.

  8. Sales tax will be added to the purchase price of all taxable items. Dealers who purchase for resale must pay said sales tax or provide a resale certificate to the Auctioneer in the name of the registrant.

  9. If for any reason whatsoever the Auctioneer fails to deliver an awarded lot, the Auctioneer’s sole liability shall be the return of any deposit or monies paid on such non-delivered lot.

  10. Auctioneer sells items on behalf of various school districts, cities, police departments, businesses and individuals and as such makes no warranty or representation either expressed or implied as to the design, condition, fitness or the merchantability of the purchased assets.
