General:  Bidders using the online auction service at TLCAuctions.com must be over the age of 18 and capable of forming legal, binding contracts. All items are sold in an "as is, where is" condition with no warranties or guarantees of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Every effort has been made to describe each item to the best of our ability; however we do not always have access to the items being sold. All descriptions of items in this sale are believed to be correct. Preview of items is strongly recommended as no refunds or adjustments will be made. TLC Auctions reserves the right to reject any and all bids and to withdraw from the sale any of the items listed.

Viewing:  Viewing of auction items will be by appointment only.

Bidding:  All bidders must register. Before you make an offer on an item, please thoroughly read all of the terms and conditions such as payment, shipping and description. Some agencies may have their own terms and conditions separate from TLC Auctions. If you do not agree with these terms and conditions, DO NOT BID. Remember - this bid is the same as a contract.  Bidding time may be extended should a bid occur in the last minute prior to auction close.  If you become the winning bidder you are legally bound by contract to purchase the item. 

Auction Close:  Successful bidders shall receive a complete invoice within 24 hours after the close of the auction. Removal dates and times are posted in each item description as well as on the final invoice.  All winning bidders must pay and remove their items within the posted dates and times, no exceptions will be made.  Some public agencies may require the winning bidder to sign a form releasing said agency from future liability as a condition of this auction.

Payment Terms:  Payment may be made thru Pay Pal or directly to TLC Auctions. Forms of payment are Visa, MasterCard, Discover, American Express, Cash or Cashiers Checks. We do not accept personal or business checks. For international customers we can only accept payment thru Pay Pal. Full payment must be received within 5 business days of auction close. In the event the bidder fails to pay the full purchase price for any lot within the prescribed time, or fails to comply with any other terms of the sale, TLC Auctions reserves the right to cancel the transaction and sell the item to another interested party and bidder may be banned from all future purchases both on-line and in person. Sales Tax will be added to the purchase price for all taxable items. Dealers who purchase for resale must pay said sales tax or provide a resale certificate prior to final payment. Sales tax rate will be based on items location. A "Buyers Premium" of 13% will also be added to all purchases. A 3% discount will be given for payments made with cash or cashiers check.

Vehicle Titles:  TLC Auctions or Seller will provide a Certificate of Title upon payment in full. No lost or misplaced titles will be re-issued. Sales tax on vehicles will be assessed by DMV and are due upon registration.

Removal Terms:  Items are available for local pickup only; we are not equipped for shipping. Items must be removed within the posted dates and times located in each item description and on final invoice. Please check quantities before removal of purchases because no adjustments will be made after items are removed from premises. All loading and labor costs are the responsibility of the buyer. Any item left after the removal deadline will be subject to resell without any obligation to refund any amount to the original buyer.

Acceptance of Terms and Conditions:  By submitting a bid, the bidder agrees that they have read, fully understand and accept the Terms and Conditions, and agree to pay for and remove the property, if the bid is accepted, by the dates and times specified.

 

Contest Rules for TLC Auctions Ipod Shuffle Giveaway

1. No purchase necessary. 

2. Entries may be made:

a. Online by filling out the registration form on TLC Auctions web page at www.tlcauctions.com. To qualify for the prize, the registration form must be filled out in its entirety, including name, email address, phone number, and postal code. A valid email address must be provided: or

b. Via regular mail by printing your full legal name, city or town of residence, telephone number, and email address (optional) on a 3” by 5” piece of paper, and mailing it to TLC Auctions at 10012 Citrus Ave., Fontana, CA 92335. To be eligible for the drawing, entries must be post-marked by the last day of the month.

3. Only one entry per person. Participants making multiple entries will be disqualified. Entries that are fraudulent are not permitted and will be declared invalid. Paper entries that are illegible, altered, mutilated or tampered with will be declared invalid. All entries become the property of TLC Auctions.


4. The contest is open to anyone over the age of 18 at the time of the drawing, except employees of TLC Auctions, or affiliated companies, their advertising and promotion agencies, or their other representatives or agents.


5. There will be (1) one Ipod Shuffle available to be won, each valued at $79.00. The prize is non-transferable, non-exchangeable, and non-refundable. TLC Auctions reserves the right to substitute any prize with a prize of equivalent retail value in the event a prize is not reasonably available at its discretion.


6. (1) One Ipod shuffle will be given away each month. The Contest winner will be drawn at 12:00 pm Pacific Time at TLC Auctions 10012 Citrus Ave., Fontana, CA 92335 during our regularly scheduled onsite auctions. Auction dates are available online at www.TLCAuctions.com. Winner must be present to win. Winner will not be eligible to win again.

7. In order to be declared a winner, the selected entrant must:

a. Have a valid picture identification card or drivers license;
b. sign a declaration stating that he/she:

1. has read, understands and complies with the Contest Rules;

2. releases and discharges TLC Auctions, the Contest organizers and their respective parents, subsidiaries and affiliates; and

3. Consents to the announcement of the winner's name and the use by or on behalf of TLC Auctions of the winner's name, address, photograph, likeness, voice or statements for advertising and promotional purposes without any further compensation to the winner.

8. Should the selected entrant fail to comply with any of the requirements set out in paragraph 10, the prize will be automatically forfeited and another entrant will be selected by random draw.

9. The chances of winning depend upon the number of eligible entries received.

10. By entering the contest, participants consent to TLC Auctions collection and use of personal information provided in contest entries for the administration of the contest and to create reports regarding contest entrant demographics and consumer habits.

11. TLC Auctions and subsidiaries and affiliates will not, under any circumstances, be responsible for, or liable to any contest entrant or any other person for:

a. any erroneous, lost, damaged, late, incomplete, misdirected, deleted, defective, or altered contest entries, regardless of the cause;

b. any failure for any reason whatsoever of the selected entrant to receive a prize notification email;

c. any changes in email addresses or email address assignments after Contest entry forms are submitted;

d. any computer, online, telephone, or technical malfunctions or errors that may occur, regardless of the cause; or

e. any damage or loss, including any loss of use, loss of production, loss of profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the Contest or the submission of entries to the Contest or participation in the Contest or the Contest prize, or the use of the TLC Auctions web site (including the downloading of any materials from that web site) and regardless of the cause or any negligence by TLC Auctions or anyone for whom TLC Auctions is responsible, and notwithstanding that TLC Auctions may have been advised of the possibility of such loss or damage being incurred.

12. If for any reason the Contest is not capable of being conducted as intended by TLC Auctions, including due to computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts or interferes with the administration, security, fairness, integrity or proper conduct of the Contest, TLC Auctions may, at its sole discretion, disqualify any entrant responsible for such misconduct and cancel, terminate, modify, or suspend the Contest.

13. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND TLC AUCTIONS RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.

14. Return of any prize notification email as undeliverable may result in disqualification, and an alternate winner may be selected.

15. Decisions of Contest Judges in respect of any aspect of the Contest are final and binding on all entrants.

16. Participation in the Contest constitutes acceptance and agreement to these Contest Rules.

17. TLC Auctions reserves the right, at their option, to publish the winner's name, address, photograph, likeness, voice or statements without any further compensation to the winner.

18. The Contest is subject to all applicable federal, provincial and local laws and is void where prohibited by law. If any provision of these Rules is found by any court of competent jurisdiction to be unenforceable, all other provisions will remain in full force and effect.

19. TLC Auctions reserves the right to cancel this giveaway at anytime without prior notification.

20. These Official Rules are subject to change each month that the giveaway is conducted. Participants should review the Official Rules each month.
